| 摘 要： | 十一届三中全会以来，我国确立了以家庭承包经营为基础、统分结合的双层经营体制，扩大了农民对土地的经营自主权。2002年的《土地承包法》规定农民对土地的承包经营权可以依法采取转让、出租、入股、抵押或者其他方式流转，扩大了农民对土地的承包经营和使用权限。与此同时，我国还逐步完善了政府对农民土地的征用办法和程序以及对农民的补偿安置办法。在新的土地制度变革过程中，还应进一步确保农民对土地的产权、完善征地制度和规范土地流转。

| Abstract: | Since the Third Plenary Session in 1978, China established the household contract management as the basis of the unified the two-layer management system, which expands the farmers’ land management autonomy. “Land Contract Law” （ 2002） has the provisions for the farmers on the land contract and management rights to take legally transfer, lease, equity, mortgage or oth-erwise transfer which further expands the contract management and usage rights of farmers on land. At the same time, the state also gradually improves the expropriation and procedures of land for farmers as well as the compensation and resettlement measures for farmers. The new land system in the process of change, we should further ensure farmers on the land property rights to improve the land requisition system and regulate land transfer. |
