| 摘 要： | 国家能力和国家权力是两个不同的概念。中国国家能力不足是一个历史现象,已成为我国法治进程中的最大障碍。强大的国家能力是维护社会秩序稳定和推进法治进程的必要保证。中国的法治进程必须加强国家的主导,提升国家能力。中国必须选择在约束国家权力的同时提升国家能力的法治之路。

| Abstract: | The concept of infrastructural power of a country is different from despotic power of a country.In China,the insufficiency of infrastructural power of a country is a historical phenomenon that is the biggest obstacle in lawruling.Strong infrastructural power of a country is an essential guarantee of a stable social order and the developrment of law rule.In the process of development of law ruling in China,the dominace of a country must be streng thened and infrastructural power improved.In China,restricting the despotic power of a country while strengthening infrastructural power of a country is the correct legal way. |
