| 摘 要： | 地方立法准备阶段必须理顺党与人大、人大与政府、人大内部相关机构之间、立法专门机关与民众民意、多元参与主体、地方立法与客观实际、地方立法与中央立法、立法准备程序与正式立法程序、法在准备阶段的立、改、废等八个方面基本关系,以便充分发挥地方立法准备阶段的功能,提高立法质量和立法效率。

| Abstract: | During the preparatory stage when laws are formulated at the local level it is necessary to straighten out the following fundamental relationships:the fundamental relationship between the local branches of the Communist Party of China and the local People's Congress;that between the local People's Congress and the local Government;that between the relevant organizations within the local People's Congress;that between the exclusive law-making body and the will of the common people;that be- tween the various participating subjects;that between the local laws and the objective reality;that between the formulation of laws at the local level and that at the central level;that between the procedures of preparations for law-making and those of official law-making;that between the formulation of new laws and alteration or abolishment of old laws during the preparatory stage.All these fundamental relationships are to be sorted out in the preparatory stage in order to give full play to the functions of the prepar- atory stage of local law-making,to improve the quality of the formulated laws and to enhance the efficiency of law-making. |
