| 摘 要： | 罚金刑的广泛适用顺应了世界刑罚轻缓化的趋势,有效弥补了短期自由刑的弊端。基于对罚金刑的理性认识,我国刑法破坏森林资源犯罪中普遍适用罚金刑。然而,执行难是罚金刑固有的缺陷。要解决此问题,须结合破坏森林资源犯罪的特点,设立罚金刑易科为自由劳动制度,并且指令犯罪人的自由劳动为植树造林,这也是救济性和恢复性环境司法的理性选择。

| Abstract: | The wide application of pecuniary penalty adapts to the trend of reprieve of penalty around the world and makes up for the defects of short-term punishment against freedom.Based on the rational cognition of pecuniary penal,pecuniary penal is generally applied to crime of destroying forest resource.But,difficult execution of pecuniary penal is its inherent defect.To solve this problem,characteristics of crime of destroying forest resource should be considered,and a system of exchanging pecuniary penal into free labor should be set up,including demanding criminals plant trees.That is rational choice for relief and restorative environmental justice. |
