| 摘 要： | 仲裁的民间性是仲裁的生命，是仲裁制度的基石，体现着仲裁价值取向。我国仲裁制度长期无法发挥其应有价值的症结就在于民间性的缺失。只有充分认识和贯彻仲裁的民间性，才能与国际商事仲裁顺利接轨，才能在和谐社会的构建中充分发挥仲裁的作用。

| Abstract: | The civilization character is the life and the base of the arbitration system that also shows the direction of the values. The problem which dysfunctions the arbitration system of China lies in the shortage of the civilization character. The only solution is to be aware and realize the character before it is connected with the international economic practice to play its due role in the construction of the harmonious society. |
