| 摘 要： | GATS作为WTO框架下的多边国际条约,对其签约国的国内有关旅游服务贸易的立法具有约束的作用,要求各成员国删去其国内旅游服务贸易立法中对旅游服务贸易的市场准入方面限制的条款,同时在外来旅游服务性投资项目建立起来之后,给予该投资项目公平的、非歧视性的待遇。这对于我国的旅游业对外投资在进入东道国市场的时候以及进入后享受到公正的非歧视性的待遇具有重要的作用。但由于GATS妥协性的特性,它在国民待遇、市场准入和补贴等方面规定模糊,因此在对旅游业国际投资的实际保护上的作用仍有待提高。

| Abstract: | GATS,as a multilateral international treaty under the WTO framework has the function of restraint on travel service trade legislation of its signing countries,requiring each member state to leave out their restraining terms about the access to internal travel service trade market in their domestic legislation.Meanwhile,when the outside travel service project is built up,the investment project should be given fair and non-discriminatory treatment.It plays an important role when foreign investment receives just non-discriminatory treatment after it enters the host country's market.But because of the compromise character of GATS,it stipulates unclearly in national treatment,market access and allowance,etc.So the function it has in actual protection of international investment in tourism industry still remains to be improved. |
