| 摘 要： | 完善继承法，制定统一民法典，是我国立法的必然趋势。适当分得遗产权是我国现行继承法创设的一种有中国特色的民事权利。文章依据现行法律、法规的规定，结合司法操作实践，分析适当分得遗产权的特征、范围和种类、法律保护及数额之认定，提出完善立法的建议。

| Abstract: | Perfecting the law of inheritance and working out a unified civil code are the inexorable trend of China's legislation, Obtaining the right of heritage properly is one of the civil rights with Chinese characteristics which is set up by China's present law of inheritance. In accordance with the regulations of China's present law and statute, combining with judicature operate practice, this thesis analyses the features, limits, kinds, legal protection and the maintain of the fixed number. Furthermore, it puts forward the suggestions of perfecting the legislation. |
