| 摘 要： | 陈亮是南宋时期著名的思想家、文学家。他生活在金人侵扰、朝廷屈辱苟安、国势危殆的时代 ,一生力主恢复 ,反对议和。他反对夸夸其谈的道学 ,提倡建立事功 ,是南宋事功学派的主要代表人。他认为 ,赏以劝善 ,刑以惩恶 ,这是“圣人所以御天下之大权者” ,因而在法制建设上提出了赏罚亦利、执法公平和宽简刑罚以及法律的因时而变、与时俱进的主张。这些主张对于今天的社会主义法制建设仍具有重要的借鉴意义。

| Abstract: | Chen Liang is a famous ideologist and litterateur in South Song Dynasty. Living in the age of the intrusion by Jin, the humiliation and seeking momentary ease of the imperial court and national crisis, he was strongly in favor of restoration and against making peace with invaders all his life. He was opposed to the windbaggery Daoism and advocated establishing careers as the major representative. He thought that awards encouraged good deeds and penalty punished evils. Thus in legal construction he put forward the ideas of beneficial awards and penalty, fair legal execution, lenient penalty and the change of law as time went. These ideas are of great significance in the socialist legal construction today. |
