| 摘 要： | 数人侵权与共同侵权之间的关系实具理论意义和现实必要性.在理论上,根据逻辑与法理,二者的完美关系应存在于各行为人是否具有共同过错这一界限点上,不具有共同过错要件的数人侵权不应当纳入共同侵权范畴,这是侵权法实行责任自负原则的必然结果,也最符合共同侵权的本质特征.在实践中,根据现行规定,二者关系的冲突点主要存在于无意思联络的数人侵权与共同过失侵权的交叉关系中,如何认定其构成共同侵权成为司法实践的难题,从确立数行为间接结合的标准出发进行了有益探索.

Theoretically, the relationship is dependent on whether the individuals committed the infringement jointly.
