| 摘 要： | 法治取“德治”而代之居于主导地位，这是历史的必然。但道德地位的历史嬗变，并不意味着道德的可有可无。在法治居于主导地位的现代社会，道德仍有其不可替代的价值。道德反映和调节主体间利益关系的特点，道德作用的特有方式和范围，以及道德作为法律的价值基础和法治的实现条件等等，都充分体现出道德的独特价值。实践证明：对道德的虚无主义的态度，不仅会导致社会道德生活的失范和无序，而且也会侵蚀在人们心目中尚未完全确立起来的法律的权威和法治的信念，影响我国的法治化进程。

| Abstract: | It is historical tendency for the Government by Law system to take the place of the Rule of Virtue principle.But such historical change of moral status does not mean that morality has become unnecessary.In the modernized society with Government by Law system in the dominant position,morality still has its irreplaceable value,and has the features to reflect and adjust the relations between subjects.Its special functions and effective scope,its value base of laws and its practical conditions of Government by Law system all embody the morality's unique value.Practice proves that the nihilistic attitude toward morality not only results in the disorder of social moral life and damages the newly set up but still immature authority and belief in laws,but also effects the progress of Government by Law system in our country. |
