| 摘 要： | 当代西方国家中日本循环经济法制建设成效最为显著。日本建立了较为完备的循环经济法律法规体系，要求国家、企业和公民合理地承担各自责任，公平地负担采取措施所需的费用，并完善了循环经济发展的政策机制，构建了科学完整的环境影响事先评价制度。我国需从国情出发，选择发展循环经济的切人点，建立和完善促进循环经济发展的法律体系。另外，要加强行政执法，加大宣传力度，增强公众参与意识，完善推动循环经济发展的政策机制和支持体系。

| Abstract: | Among the contemporary Western countries, the achievement of Japanese constructing works of legal system of circular economy is the most remarkable. Japan has established relatively complete legal system of circular economy, requiring country, the enterprise and the citizen undertaking the respective responsibility reasonably, burdening the expenses fairly and reasonably, consummating the circular economic development policy mechanism, constructing the scientific and complete environmental effect beforehand the evaluation system. Based on China＇s situation, it＇s necessary to choose the cut over point, to set up and perfect the law system promoting circular economy development; in addition, to strengthen administrative law enforcement, the power of propaganda, the participatory sense of public, to perfect the policy mechanism and supporting system of promoting circular economy development. |
