| 摘 要： | 私有财产权在各国宪法中占有重要的地位，各国宪法都把财产权问题作为其宪政的基石之一。而我国宪法对私有财产权的保护却经历了几十年的风风雨雨。2004年3月14号第十届全国人民代表大会第二次会议通过的宪法修正案明确了对私有财产的保护，给全民尤其是民营企业带来了新的生机和动力，这具有重要的意义。但目前的形势仍不容乐观，仍有许多应改善的地方。

| Abstract: | The privately owned proprietary occupies the i mp ortant position in the constitutions of various countries, the constitutions of various countries regard proprietary question as one of the foundation stones of its constitutional governement. Trials and hardships that the constitution of o ur country has been gone through to its protection for decades. Clear protection of the private property of constitutional amendment that the second session of the tenth National People's Congress will be passed of the 14th of March, 2004, bring new life and motive force to the whole people, especially enterprise run b y the local people, have important meanings. But the present situation still all ows of no optimist, there are a lot of places that should be improved. |
