| 摘 要： | 立足于我国宪法解释的现状，无论从最高人民法院以司法方式解释宪法的社会基础和活动空间亦即其面临的现实动力和压力方面，还是解释的运作方式和实际表现亦即其个案和附带性质方面，我们都可以看出，宪法司法解释得以规范和奏效很大程度上有赖于其在我国几个效力不同、功能各异和相对独立的宪法解释所构成的有机联系的宪法解释体制中符合司法的特性及其依附的政治体制架构。 |
