| 摘 要： | 东海争端的焦点是划界原则和钓鱼岛归属问题，中国主张以大陆架原则划界。钓鱼岛是中国固有领土，而日本提出中间线原则并占有钓鱼岛。本文论述中日两国东海争端的内容、现状和实质，从历史、国际法和逻辑角度阐述中日东海争端中中国立场的合法性和合理性，并分析东海油气资源对中国石油安全的意义，最后提出东海争端解决的前景和思路。

| Abstract: | The focus of the East China Sea dispute are vested in the delineation of the principles and the Diaoyu Islands issue, China advocates the principles of delimitation of the continental shelf, the Diaoyu Islands are China＇s inherent territory, while Japan put forward the principle of the median line and occupy the Diaoyu Islands. This paper discusses the con- tent .status and substance of the Sino-Japanese East China Sea dispute , expounds China＇s position in legal rationality from the history, international law and the logic of the perspective of Sino-Japanese East China Sea dispute , and analysis of the East China Sea oil and gas resources on the significance of China＇s oil security. Finally, this paper puts forward the East China Sea dispute settlement prospects and ideas. |
