| 摘 要： | 在倡导建设社会主义法治的情境下，中国日渐走上了由政府主导的法制改革道路，于是移植西方文明国家的法律成为优选。但是改革中的问题，却一再提示我们要注重中国国民心理，中国国民特有的心理惯性，正确处理外来法律与民众心理的冲突。

| Abstract: | China gradually begins its reforming of situation of the building of a socialist country under the the legal system dominated by the government under the rule of law. The using of the western countries＇ law as a source of reference is a preference. However, the problems emerged in the process of the reform indicate that we should pay attention to Chinese national mentality. We should deal with the conflicts between the national mentality and the foreign law. |
