| 摘 要： | 代孕技术作为一项人工辅助生殖技术,改变了传统生育方式,给没有生育能力的夫妻带来了福音,同时对传统的生育观和法律制度提出了挑战。为了保障代孕母亲、代孕子女以及委托夫妻的合法权益,在不违背社会公共利益的前提下,应对代孕生育的主体和生育协议进行法律规制。

| Abstract: | Surrogate,which is a helpful reproductive skill,has brought happiness to more and more infertile couples.At the same time,it has changed traditional means of pregnancy and challenged against both the traditional ideas and legal system on pregnancy.In order to protect the legal rights of the mothers,children and the entrusting husband and wife in surrogate pregnancy,we should make law to regulate surrogate pregnancy on the premise of not conflicting with the social public interests. |
