| 摘 要： | 宅基地使用权萌芽于上个世纪60年代,在城乡二元结构的体制中逐步发展,到90年代定型。带有强烈计划经济色彩的宅基地使用权制度具有身份性、福利性的特征,忽略了用益物权本身具有的财产价值;现行规范在宅基地使用权定位、取得、行使、转让等方面均存在缺陷,受到来自现实的诸多挑战,《物权法》专章规定了宅基地使用权,为完善该制度提供了空间,使建立符合物权法原理、适应农村发展实际的宅基地使用权制度成为可能。

| Abstract: | Right to use the rural residential bases sprouted in 1960＇s, developed gradually in the system of urban-rural binary structure, and came into a firm state in 1990＇s. It has the features of identity, welfare, ignoring the value of usufructuary right itself. The current specifications are defective in the right to use the rural residential bases in terms of use location, exercise, transfer, and are facing many challenges from reality. Real Right Law specifies the right to use the rural residential, providing some room for improvement, and make the establishment of the system of the right to use the rural residential bases possible which conforms to the principle and is adaptable to the actual development in the countryside. |
