| 摘 要： | 知识产权领域的权利冲突现象是客观存在的,由于目前的知识产权法律体系不够完善,司法界在解决这一问题时所依据的“保护在先权利”原则仍存在一些问题,这在理论上有违知识产权制度的宗旨,在司法实践中也不利于保护相关利益主体的合法权益。笔者尝试提出关于权利冲突的法律概念、产生的原因以及适用“保护在先权利原则”时应注意的问题,对目前我国的立法缺陷提出了完善建议。

| Abstract: | Since the current system of intellectual property law is still not perfect,conflicts in the field of intellectual property rights are objective phenomena.Based on the principle of "first rights protection",some problems still exist in the settlement of that issue.Theoretically,it is contrary to the purposes of intellectual property system.In the judicial practice,it is not conducive to the protection of the legitimate rights and the interests of relevant interest groups.The writer advances the legal concept of rights conflict,the reasons,the issues in the application of principles of the " first rights protection ",and some good proposals are put forward as well. |
