| 摘 要： | 知识产权领域是存在法律冲突的，但这种法律冲突既不来源于国际条约对知识产权提供保护的国际性，也不来源于知识产权管辖权制度的新发展，它只源于一国对外国知识产权法域外效力的直接承认，而这种直接承认在目前看来是非常有限的。因此，知识产权领域内的法律冲突也只在有限的范围内存在。

| Abstract: | Conflicts of laws really exist in the field of intellectual property. But it does not lie in the international protection for intellectual property by international treaty and not originate from the new development of jurisdiction concerning intellectual property. In fact, the conflict is resulted from the direct recognition of the extraterritorial effect of a foreign intellectual property law. Because the recognition is still rather limited up to now, so the conflicts in the field of intellectual property can only exist in a narrow scope. |
