| 摘 要： | 法官惩戒制度在保障法官身份，制约监督法官行为方面有着重要意义，我国法官法规定了法官惩戒制度很多方面都存在缺陷，我国存在的另一种惩戒法官的制度－错案追究制，因其本身的不合理性应予摈弃，对法官的惩戒应立足于对行为的控制，应立足本国国情，借鉴国外经验，并制度化，法律化。

| Abstract: | Judge disciplinary system is very important to ensure judge's status,control judge's behavior.Judge disciplinary system regulated in The Law of Judge of China has many drawbacks.The alternative judge disciplinary system-wrong case investigation system should be discarded because of its irrationality.Judge discipline should be a law and system which based on behavior control,national situation,and experience of foreign country. |
