| 摘 要： | 政策性担保公司市场退出必须妥善处理好善后事宜中的利益保护与责任承担。担保保险制度的安排可以有效保护银行、被担保人等债权人的利益;市场退出担保公司的担保合同只能转让不能终止,再担保公司应成为合同转让的法定受让人,转让合同的内容不得变更;政府、银行、再担保公司都应承担相应的损失。
