| 摘 要： | 诚信原则是人类道德或人类理想在社会发展不同阶段的体现，也是变动的自然法的缩影。现代意义的诚信原则是在当事人之间的利益关系和当事人与社会之间的利益关系中实现平衡。现代诚信原则的价值基础是由市场环境、市场主体、立法－－司法模式等影响其本质变化的因素所决定。其价值判断包含社会妥当性、实质正义、公法手段介入私法合理化等价值标准。

| Abstract: | Good faith principle is the reflection of human morality and human ideal of different stages in social development.At the mean time,it is the miniature of changing natural law.Good faith in modern sense balance the benefit relationship between the agents as well as between agent and society.Its value base is decided by market environment,market main body and legislation judicature which influences its nature.While the value judgement includes social appropriateness,substancial meaning,rationalization of public law's intervention of private law. |
