| 摘 要： | 学生惩戒自由裁量权从其来源、行使过程与结果来看，是一种伦理性质的权力。法律不可能杜绝学生惩戒自由裁量权，而伦理具有有效控制惩戒自由裁量权的作用。基于这一认识，本文论述了学生惩戒自由裁量权的伦理属性、伦理制约功能、行使的伦理原则以及伦理制约机制等几个方面。

| Abstract: | Discretion in deciding student penalty is a power of an ethical nature in light of its origin and exercise.Law cannot eliminate this discretion but ethics may restrict its execution.On the basis of this view,a discussion is presented on the ethical nature and principle of the discretion,and the ethical restriction function and mechanism for such discretion. |
