| 摘 要： | 源起于德国公法帝王原则的比例原则脱胎于自由法治国。传统“三阶论”的规范结构不包括目的正当性,近来,多国法院通过不同方式介入对公权力目的正当性的审查,形成了三种主要的审查类型。公权力行为、手段正当的前提是目的正当,将目的正当性审查作为妥当性原则的同时或者前置环节,确立其为比例原则审查步骤中的预备阶段可能是一个修正的路径。这样的程序设计既不改变阶层秩序理论的规范结构,又使其成为一个不可或缺的独立审查环节,通过司法理性与适度克制审查行政行为的目的正当性。

| Abstract: | The principle of proportionality originated from the principle of German public law monarch and was born in the era of free law.The traditional“three-level theory”normative structure does not include the legitimacy of purpose.Recently,multi-national courts have intervened in the examination of the legitimacy of the purpose of public power in different ways,forming three main types of examination.The premise of the legitimacy of public power behavior and means is the legitimacy of purpose.We can take the legitimacy of purpose review as the same time or pre link of the principle of appropriateness and establish it as the preparatory stage in the review step of the principle of proportion,which may be a path of reform.Such a program design not only does not change the normative structure of the hierarchy order theory,but also makes it an indispensable independent review link.The purpose is to review the legitimacy of administrative acts through judicial rationality and moderate restraint. |
