| 摘 要： | 行政立法寻租是经济利益主体通过部门立法或立法代言人介入立法,制定带有利益倾向性的行政法律规范的活动。它是市场经济条件下滋生的新问题,是委任立法权力与部门利益求租意向结合的产物,暴露了立法监督功能的弱化。行政立法寻租浪费社会资源,降低经济效率,最终破坏政府形象,导致腐败,阻滞法治进程。治理行政立法寻租,应当从立法模式、立法制度、立法监督等方面着手,探索法律对策。

| Abstract: | The rent-seeking of administrative legislation is a new field of rent-seeking after the power rent-seeking and the economy rent-seeking.The rent-seeking of administrative legislation is a new issue appears under the situation of market-economy which wastes social resources,decreases the economy efficiency,destroys the governmental image,hinders legislative procedure at last.It is feasible that to deal with this issue from the legislative mode,system and supervising machine. |
