| 摘 要： | 宅基地使用权制度改革迫在眉睫,我们在重新审视宅基地使用权制度内涵基础上,提出现行制度安排,突出了资源规制功能,兼顾了社会保障功能,淡化了财产功能,这与我国目前经济社会发展不相适应,不利于土地资源的合理配置.因此,改革宅基地使用权制度,应在改善公法对宅基地使用权的不当干预,改革宅基地实物保障为货币化社会保障的前提下,完善宅基地使用权的物权功能,积极稳妥探索宅基地流转问题.

| Abstract: | The homestead use right system reform is urgently needed,Based on re-examining the system of homestead right to use,we found that this kind of system outstanded resources regulation,took into account the social security function,diluted the property,so it didn’t adopt the current economic and social development,and it didn’t favor the land reasonable allocation of resources.In order to reform the homestead right to use system,under the premise of improving the improper intervention of the public law,and changing matter security into monetized social security,we should improve the homestead right to use property functions,and actively and steadily explore circulation problems of homestead. |
