| 摘 要： | 处于社会急速变革中的我国，在社会经济结构、国家政治体制、人们思想观念与生活方式发生巨大变化背景下，新类型民事案件日益涌现，而形成鲜明对比的是现行民事实体法与程序法突现出严重滞后性。当事人因“新类型权利”或“形成中的权利”在民事诉讼中体现出的诉权称之为“形成中的民事诉权”。本文主要研究形成中的民事诉权概念、特征、在司法实践中的现状，还探讨了形成中的民事诉权的提出、表现及保障。通过对上述问题的研究，期望能为人民法院在实践中如何更好地面对不断新涌现的民事纠纷提供理论依据，并且希望对未来民事诉讼法在诉权方面的立法修改提供建设性意见。

| Abstract: | Our country is in the rapid transforming of society,not only in the socio-economic structures,but also in the political system,and the idea,the life style of people.The justice of law has to be realized through the justice of procedure.The new rights are defined to be "forming rights" or "new type of rights" by scholars.The thesis based on the civil cases,analyzed the concept,the condition of forming civil litigation right,and how to institute such litigations,and how to display,how to safeguard such litigation rights.Through these investigations, the writer expected to provide theory to the civil adjudication of courts,and expected to receive valuable ideas on civil procedural law in legislation in the future. |
