| 摘 要： | 教师申诉制度自1993年《教师法》确立以来,为保护教师合法权益、创建和谐校园等方面发挥了一定的作用,但是申诉制度的本质决定了教师申诉制度存在不可克服的缺陷,要想真正实现教师申诉制度的目的,必须将教师申诉制度纳入人事争议仲裁制度。为此必须尽快制订《人事争议仲裁法》、扩大人事仲裁的范围、加快教师聘用制的实施等。

| Abstract: | Since the establishment of Pedagogic law in 1993,teacher appeal institution has played a role in protecting the teacher’s legal rights and interests and creating a harmonious campus,but teacher appeal institution exists insurmountable defects because of its nature.To truly realize the purpose of teacher appeal institution,we must put teacher appeal institution into personnel disputes arbitration system.Therefore,we must establish personnel disputes arbitration law as soon as possible,expand the scope of personnel arbitration and speed up the implementation of system of teachers recruiting. |
