| 摘 要： | 行政行为的公定力是行政行为效力的一部分。传统行政法学认为,行政行为一经做出即具有公定力,应当被推定为合法有效,对行政相对人、行政相关人和有关行政主体均产生法律上的约束力。但随着民主、正义理念的深入及行政法治和理论的发展,行政行为公定力的传统理论依据和制度构建逻辑的不完善之处逐渐显现,因而需要对行政行为公定力重新认识。对行政行为公定力予以完全否定甚至抛弃的选择不可取。合理的认定是,行政行为的公定力不是绝对的,而是有一定限度的,即行政行为公定力具有有限性。

| Abstract: | The presumptive legality of administrative act is a part of administrative effectiveness.According to the traditional administrative law,once an administrative act is conducted,it will have the public enforcing force and should be presumed as legal and effective,and it is also supposed to have sanctions to both the relative party of administration,the private party and the related administrative subject.However,with the implanting of the conception concerning social democracy and justice and the development of legal system and theory in terms of administration,the origin that produces the presumptive legality of administrative act has changed a lot,and its theoretical gist and system construction logic are imperfect,too,so it is necessary to be acquainted with the presumptive legality of administrative act again.In spite of this,the penman of this article doesn't propose to completely negate or abandon the presumptive legality of administrative act but believe that the public presumptive legality of administrative act is not absolute and is limited,that is,the public enforcing force has limitations.Thus it is most likely to avoid the theoretical extreme and to make the theory of the presumptive legality and the concept of equity and justice match each other. |
