| 摘 要： | 立法后评估制度是完善地方立法制度与体系的一种新尝试。中央与地方之间存在立法权限分流，其对法制统一有消极制约。立法后评估可遏制地方立法中违背法制统一的不利因素。，该制度是将地方性立法建设成“回应型法”的重要手段。立法后评估制度以法律实效作为自己的理论阂值和价值目标，并力图实现立法、执法、守法之间的良性互动。

| Abstract: | Evaluation system of post - legislation is a new try to perfect local legislation system. The system can reduce the disadvantage of legislative distribution between the central and the local legislator, which affects passively the uniform of le- gal system. It is an important way to construct local legislation with the character of responsiveness and is helpful to resolve the dilemma of stability and rigidity statutes are facing. The evaluation system of post - legislation has its own objective and theoretical threshold which is the actual effects of law. The system tries to realize the upstanding interaction among legislation, executing of law and keeping the peace. |
