| 摘 要： | 法律沟通在审判中、在当事人之间以及在立法、司法中是普遍存在的,具体表现在法官、检察官、诉讼当事人、诉讼参与人及其他们相互之间的沟通,契约和非契约当事人之间的沟通,立法、司法及其他们相互之间的沟通。法律沟通的作用主要表现在:降低成本,节约资源;减化矛盾,促进和谐;满足需要,实现目的;提高效率,维护权威。法律沟通的障碍:一是法律的抽象性难以理解;二是情理法的不一致性令人费解;三是法官自由裁量案件结果的不统一会影响法律沟通;四是案件的不能有效执行阻碍法律沟通。法律沟通的技巧包括:法律沟通的主体要相互尊重和理解,法律沟通的语言要通俗易懂和富于幽默感,沟通要因时、因地、因人而异,等等。

| Abstract: | This is common for the use of legal communication in trial and during the parties. The same is also true with the legislation and judicature. It inchudes court, court prosecutor, contesting party, nonjudicial participants, contracting party and noncontracting party, legislation and judicature. The main role of the legal communication in- dudes ： the cost of reducing, the resource of saving, the contradiction of reduction, the peace of promotion, the need of expiration, the aim of fulfillment, the efficiency of improving and the authority of maintenance. The barrier of le- gal communication includes ： the abstract of law＇s concept, the deference of argument and law, the right of discretion and the unimplement of the case. The skills of legal communication include ： they must be respected and understood for the subject of legal communication ; the language of legal communication must be understood easily and with hu- mor, the legal communication must be different for the case of the time and sport and people. |
