| 摘 要： | 在知识产权保护水平不断提高的新时代,著作权风险成为困扰图书馆发展的问题。文章以风险管理为理论视角,从风险识别、风险评估和风险防控三方面归纳图书馆著作权风险研究成果的共识和分歧。在风险识别方面,现有研究主要通过案例分析和流程分析等方法对风险进行识别,而随着图书馆业务类型的丰富和著作权法律的修订,亟待引入新的风险识别模式以应对风险因素的快速扩张;在风险评估方面,图书馆著作权风险评估研究还处于起步阶段,评估过程过于依赖研究者自身或专家的主观认识,缺少客观数据支撑,不同研究建立的指标体系和评估结果之间存在显著差异;在风险管控方面,现有研究强调内部管理、合同、社会治理等各种手段的协同作用,但未能阐明各措施的防控效果和作用机制。着眼于政策法规等规范性文件的合规风险管理框架,能够很好地整合现有研究基础,弥补现有研究的不足,为图书馆著作权风险研究的进一步发展提供新的理论工具。

| Abstract: | With the improvement of intellectual property protection,the copyright risks have been the main problem that perplexes the development of Chinese librarianship.Guided by the theory of risk management,this paper sums up the consensus and divergence of current researches on library copyright risks in China from the aspects of risk identification,risk assessment and risk handling.In terms of risk identification,case analysis and process analysis are most commonly used to identify library copyright risks.Besides,with the expansion of library services and the revision of the Copyright Law,it is urgent to introduce new risk identification modes to deal with the rapid expansion of risk factors.In terms of risk assessment,research on library copyright risk assessment is still in its initial stage.The assessment process relies too much on the subjective understanding of researchers and experts.Due to the lack of objective data,there are significant differences between the established index evaluation system and the evaluation results.In terms of risk handling,the synergistic effects of various measures such as internal management,contract and social governance,are generally emphasized,but the specific role and mechanism of each measure hasn’t been clarified.It is found out that the compliance risk management framework which focuses on normative documents like regulations,policies and industry guidelines can integrate and complement current researches,and thus provide a new theoretical tool for future researches on library copyright risks. |
