| 摘 要： | 道路交通事故损害赔偿责任，在《民法通则》和《道路交通事故处理办法》中分别都有规定，但是两的规定不尽相同，章对这两部法律，法规中关于道路交通事故损害赔偿责任的构成要件进行了分析，阐述了实践中如何具体适用这两部法律，法规的问题。
