| 摘 要： | 治安管理处罚自由裁量权有其存在的法定条件,实务中往往存在不规范使用现象。各种客观、主观因素构成对治安管理处罚自由裁量权的影响。有效防止权力滥用和保障公民权利,需要从制度和管理层面满足治安管理处罚自由裁量权的合目的性要求,给其以必要的规制。

| Abstract: | Discretion in security administration punishment has its legal condition,and it is often used improperly in law enforcement practice.All kinds of subjective and objective factors influence discretion in security administration punishment.In order to prevent abuse of power and guarantee civil rights,we must meet the purposiveness demand of discretion in security administration punishment from system and management level,and give the discretion necessary regulation. |
