| 摘 要： | 秦汉时期,伴随着私有经济的发展,各种涉及财产、婚姻、人身侵权等民事案件出现。国家不仅制定了严苛的民事法规,并相应建立一整套民事诉讼制度,确保对各类民事案件的预防和控制,维护封建道德和社会秩序。从已出土的《睡虎地秦墓竹简》、《张家山汉墓竹简》、《居延新简》等简文资料,可窥探秦汉发达和精细的诉讼程序。

| Abstract: | Various cases concerning property,marriage and personal civil infringement occurred with a private economic development in Qin and Han Dynasties.Civil laws and statutes have been laid down by nation during Qin and Han Dynasties.We can probes into the elaborate and advanced civil litigation procedure from bamboo and wooden slips unearthed in Shuihudi,Zhangjiashan and so on. |
