| 摘 要： | 中国传统社会存在着大量的契约活动,并为我们留下了数量可观的契约文书。从几个中国传统契约文本及其中的套话看,传统中国人在签订契约的时候普遍对签约对方持不信任的态度,即使对方是直系亲属。
