| 摘 要： | 《中华人民共和国刑法》第20条第3款规定特殊防卫权,在鼓励公民更好地利用防卫权、遏制和预防犯罪方面起到了一定积极作用,但由于法条本身的不确定性,使得司法实践中对其很难把握,而且特殊防卫权的设立存在很多弊端,影响了我国的人权建设,所以应该对特殊防卫权给予必要的限制,以防止其背离立法的初衷。

| Abstract: | The establishment of special defense right in clause three Article 20 of criminal law of the people’s republic of china plays positive role in encouraging citizens to make better use of self-defense right and to contain and prevent crime.Due to the ambiguity of the law itself,it is difficult to make judicial judgment in judicial practice.The establishment of special defense right have many shortcomings,becoming the obstacle of development of human rights.It is necessary to impose certain limitation on special defense right to avoid its departure from the original intention of legislation. |
