| 摘 要： | 金融衍生品交易在当今金融交易中已经占有了较大的部分,在世界金融市场具有举足轻重的地位,但由于金融衍生品交易本身的特性,对其的法律规范和监管并不完善。对金融衍生品交易的法律性质的甄别是对其金融监管策略的重要考虑因素之一,本文也主要是对此进行研究。

| Abstract: | The financial derivatives transaction has occupied a larger portion in today’s financial transactions,plays a decisive role for the world financial market,because of the own characteristics of financial derivatives transactions laws and regulation is not perfect.The screening of legal nature of financial derivatives transaction is the important factor of financial regulatory strategies,this paper is mainly to study it. |
