| 摘 要： | 在现代的法治国家中,宪法具有至上性和权威性,是国家的根本大法。从法律的效力等级来看,宪法具有最高的效力,其他一切法律规范都不能与宪法相抵触,所以宪法监督对于国家法律的实施具有重要的意义。迄今为止,我国的宪法经过了多次修订,在宪法的监督制度上也已经有了很大的进步,但是仍然存在着一定的缺陷。为了进一步完善宪法监督制度,应结合我国的实际情况,同时对域外的先进制度予以借鉴,以促进宪法监督制度的进一步法定化、制度化和程序化。

| Abstract: | The constitution is the fundamental law of the state. It has supreme authority in the modern country under the rule of law. The constitution has the highest effectiveness from the legal effect hierar- chy. All other laws may not conflict with it. So the constitutional supervision to national law enforcement has important significance. To date, the constitution of our country has experienced many revisions and the constitution supervision system has also made great progress. But there still exist some defects. In or- der to further perfect the supervision system of the constitution, The legalization, institutionalization and proceduralization of constitutional supervision should be further promoted in accordance with the actual sit- uation of our country while drawing lessons from the foreign advanced svstem. |
