| 摘 要： | 夫妻财产制在夫妻关系中占有重要地位，实践中的大量纠纷也因此而发生。夫妻财产制与民法的其它制度如共有制度、代理制度、无权处分制度有密切联系。现行法对夫妻财产制的规制有疏漏和模糊的地方，导致了司法实务中的不少困惑和两难。
