| 摘 要： | 伴随着市场经济的持续、快速发展，交通事故频频发生，交通肇事逃逸也呈逐年递增趋势。然而，我国现行刑法对交通肇事罪的规定还较为笼统，交通肇事逃逸及“因逃逸致人死亡”只是作为一个量刑情节发生作用，依据我国刑法理论并结合司法实践对交通肇事逃逸致人死亡的含义、特征和罪过形式进行剖析，进而对交通肇事逃逸致人死亡的疑难问题进行系统、深入的研究。

| Abstract: | With the sustainable and quick development of market economy, escape from traffic accidents is rising year by year. However, Current criminal law in China is general in regulations of traffic accident crime, and tragic accident escape and ＂causing death due to escape＂ are only regarded as circumstances of sentencing. According to the criminal law theory, combined with the judicial practice, the present article analyses the meaning, feature and crime form of causing death due to traffic accident escape and further a systematic research is dealt with towards this issue. |
