| 摘 要： | 佛教传入中国后主动融入中国传统文化,接受本土法律的规制,佛教教义和戒律逐步刻上了中国传统法律思想的烙印。同时,佛教教义和戒律中的众生平等、慈悲报应、地狱、忍辱和合等思想也日益影响着传统法律思想,改变或强化着帝王贵族、氏族官僚以及普通百姓的立法、执法、司法、守法观念。究其原因,佛教以儒家思想为桥梁影响传统法律思想、佛教受世俗法律的特殊规范、佛教戒律与法律的相通与互补等因素使佛教影响传统法律思想具有一定的必然性。

| Abstract: | Buddhism incorporated into Chinese traditional culture and put itself under local legal regulation autonomously when it diffused into China. Buddhist teachings and commandment are branded with Chinese traditional legal thought. Meanwhile, some thoughts such as Equality of all beings, Compassion and Retribution,Hell, Patience and Harmoniousness had more and more influences on traditional legal thought. They changed or strengthened the concepts of emperor and nobility, bureaucrats and people on legislation, law enforcement, justice and abidance by law. That is because of following necessary factors： firstly, Buddhism influenced traditional legal thought bridged by Confucian ideas. Secondly, Buddhism was regulated specially by secular law. Thirdly, Buddhist commandment and law had communicant and complementary factors. |
