| 摘 要： | 正义是法学的灵魂 ,权利是法律关注的永恒主题 ,古希腊的正义理念对古罗马法中维护权利的观念提供了精神知识的养料 ,斯多葛学派的自然法学说为抽象正义理念与务实的权利观念的融合提供了桥梁 ,而正当性是二者可以实质交融的契合点。
