| 摘 要： | 可得利益又称期待利益,"可得利益可赔偿"的原则,在我国<合同法>已确认,但如何科学地界定可得利益损失的赔偿范围及方法还是争论的焦点.要解决此问题,从司法实践的角度看,难点在于可得利益赔偿的认识性问题和如何赔偿的实践性问题.首先要分清可得利益损失、间接损失和信赖利益损失,其次确定可得利益损失的范围以及赔偿的方法.可得利益损失主要是守约方的利润损失,守约方可能得到的利润就是其范围;赔偿方法主要是约定法、收益对比法和衡情估算法.

| Abstract: | Can get benefit is called expectation benefit.It have confirmed for the "contract law" of our country that " can get benefit can compensate ",but how to scientific boundary the compensation scope and method that can get benefit loss surely still the focus of argument.To solve this problem,referring to the angle of judicial practice,difficulty lies in the knowledge problem of can get benefit compensation and the practicality problem that how to compensate.First,we want district to distinguish can get benefit loss and indirect loss and trust benefit loss;Secondly,we determine the method that can get compensation as well as the scope of benefit loss.It is mainly the profit loss about to get benefit loss of the guard side,it is its scope to the guard side that may get the profit approximately;Compensation method is the method stipulated mainly,the method of profit contrast and the estimation method of according to condition. |
