| 摘 要： | 不动产租赁权具有物权的基本属性,首先应在理论上还不动产租赁权为物权性质的本来面目;不动产租赁契约与不动产租赁权具有本质的区别,不能把二者混为一谈;不动产租赁权是用益物权,是传统民法上之地上权和准物权。不动产租赁权在我国为特别物权,研究不动产租赁权的性质及在实践中的应用,最主要的是将其与债权区分开来。

| Abstract: | The leasehold of real estate possesses the essential features of real right. Contract of Leasehold of real estate is basically different from leasehold of real estate. The leasehold of real estate is the usufruct and special real right in China. A study of the nature of the leasehold of real estate and its application mainly focuses on distinguishing it form creditor's right. |
