| 摘 要： | 无独立请求权第三人制度是我国民事诉讼法中的一项重要主体制度。其参诉方式的制度设计存在的矛盾和弊端，导致了理论和司法实践的分歧。有必要通过对法院通知参诉的多种弊端和深厚继存土壤进行解析，提出相对合理的渐进式革新方案。该方案要求暂时保留法院通知参诉并对其进行严格限制，对不同类别第三人适用不同参诉方式，对依据不同的法院通知参诉区别对待，以达到取消法院通知参诉为目的，从而最终实现无独立请求权的第三人制度立法之本意。

| Abstract: | The system of the third party without independent claim is an important subject institution in civil procedure law.The way of the third party’s intervention has a lot of contradictions and defects,which lead to the divergence between legal theory and judicial practice.It is necessary to analyze the various defects and deep soil for continuing to exist of the mode of intervention by notification from the court,proposing an innovation plan which is both reasonable and gradual.The plan requires the court to reserve the mode of intervention by notification temporarily with strict restriction.Different modes should applied to different kinds of third party and modes of intervention by notification from the court on different foundations should be treated differently.So the court can stop notification of intervention and fulfill the original idea of the system of the third party without independent claim. |
