| 摘 要： | 长期以来，国际法与国内法关系问题在国际法理论上颇有争议。而且，由于它涉及国际法的法律性质、效力等重大方面，因而成为国际法的基本理论问题之一。实质上，国际法的效力与实施是国内法问题。目前，国际习惯法入宪是各国的普遍做法。我国宪法应根据符合本国国情的政治和法律制度的特点，以及有利于国家利益的原则，科学合理地确定国际习惯法在我国法律体系中的相应地位。

| Abstract: | For a long time,the relation of International Law and National Law is a controversial issue,which has become one of the basic theoretical issues because it is related to the effects and nature of International Law.Actually,the effects and application of the International Law is related to National Law,and to incorporate International Law into the Constitution is a common practice in all countries.Therefore,it is necessary for China to determine the position of Customary International Law in China's Constitution in accordance with the characteristics of our political and legal systems as well as the principle of benefiting the state. |
