| 摘 要： | 国际私法上的“意思自治”原则与民主法上的“意思自治”有着很大的区别 ,不能简单地将其价值追求归结为追求个人自由与尊重当事人意志 ,其更大的价值在于能更好地维护国际交往利益 ,因而不似民法上的“意思自治”那样与国内经济及政治思想的自由共兴衰 ,它的产生、发展与兴衰更多地反映的是国际交往利益的需要 ,那么 ,其能在民法上的意思自治走向衰落时在国际私法领域拓展出更大的空间

| Abstract: | There is great distinction between the principle of "autonomy of will"of the international private law and the principle of "autonomy of will"of the civil law.Its value pursuing can't simply be summed up as seeking perxonal freedom and respection the will of the person concerned.Its great value lies in the fact that it can better safeguard the interest of international exchange.Hence,the principle of autonomy of will of the international private law is different form the principle of autonomy of will of the civil law,which rises and declines together with the freedom of demestic economy and political thinking.Its emergence,development and vicissitudes rdflect more the needs of the interest of international exchange.Therefore,with the decline of the autonomy of will of the civil law, it will exert a stronger influence upon the field of the international private law. |
