| 摘 要： | 根据物权法理论和国际通行做法,不动产登记应当以土地权利的登记为中心,由统一的机关进行。而我国的不动产登记却被分散在各个不动产行政管理部门。刚出台的《物权法(草案)》也未对这种罕见的“分头登记”采取任何实质性的对策。《物权法(草案)》为什么要回避如此重要的问题呢?笔者认为,其根源在于不动产登记领域内的部门利益已经根深蒂固,并且已经在一定程度上影响到了国家的立法权。更为严重的是,这种不动产的“分头登记”已经阻碍了市场经济体系的建立和经济的快速发展。

| Abstract: | According to the theories of the property law and the international common practices,the registration of real estates should be centered on the registration of land rights,and the registration is performed by a unified department.However,the registration of real estates in China is separately done in separate administrative departments of real estates.The newly enacted Property Law(Draft) does not take any substantial measures on this "separate registration".Why does the new law evade such an important issue? I think that the root is that departmental interests in the real estate registration realm are deeply inveterate,which has posed an impact on the national legislation.What's worse,this kind of "separate registration" has hindered the establishment of market economy system and rapid development of economy. |
