| 摘 要： | 权力制约的制度建构必须充分调动全社会的权力监控资源并进行有机整合方能实现。民法的功能不仅在于为现代市场经济提供行为规范，同时作为私法的民法亦具有潜在的权力制约功能。当代中国市民社会与政治国家现实上的分离构成了民法权力制约功能的社会基础，民法权力制约功能的现实依据在于民法理念的更新，民法内在的民事规范、民事权利、民事责任三位一体的权力制约机制更是现代多元控权景观中一道亮丽的风景线。民法潜在的权力制约功能的凸显，要求我们在进行权力制约的制度设计时，不应仅仅拘泥于对公法的关注，私法乃至非法律的规则也可能会给我们一些有益的启示。

| Abstract: | The civil law not only provide the behavior norm for the modern market economy, but also as a kind of private law, has the potential functions of power supervision as well as. The separation of civic society and political country in contemporary China underlies the social foundation of functions of power restriction in civil law. The ground of this kind of power restriction lies in the renewal of civil law principle. Of course, the civil norms, civil rights and civil responsibilities come into being the beautiful scenery in the system of the modern power restriction. The showing of latent power restriction functions in civil law requires that we had better not focus on the public law.The private law and non-law regulations may give us some useful revelations when we devise the systems of power restriction. |
